New 16 vacancies for the posts of District Judge in the High Court of Karnataka.

New Delhi: – Online applications are invited in the prescribed form from eligible candidates for 16 vacancies for the posts of District Judge, in the Judicial Service of the High Court of Karnataka.

It is hereby notified that under Article 233 of the Constitution of India read with the provisions of the Karnataka Judicial Service (Recruitment) Rules, 2004 and Amendment Rules 2011, 2015, and 2016, the High Court of Karnataka invites online applications from eligible candidates for filling up of 16 vacant posts of District Judges (14 backlog and 2 new vacancies) by direct recruitment.

QUALIFICATION:

  1. Must be the holder of a degree in Law granted by a University established by Law in India;
  2. Must be practicing as an Advocate in the High Court or a Subordinate Court on the last date fixed for receipt of applications and must have so practiced for a period not less than SEVEN years as on such date.

Note: Public Prosecutor/Assistant Public Prosecutor/Government Counsel in full-time employment of the State having not less than seven years of continuous practice immediately preceding the last date fixed for receipt of online applications are also eligible for appointment.

AGE LIMIT: Must not have attained the age of Forty-Eight years in the case of candidates belonging to Scheduled Castes or Scheduled Tribes and ¨sauna– 5 Part – V, 20 2022( 29 1944) BENGALURU, TUESDAY, 20, SEPTEMBER, 2022(BHADRAPADA, 29, SHAKAVARSHA, 1944). 468No. 468 2 Forty-Five years in the case of others, as on the last date fixed for receipt of online applications.

Note: The maximum age limit is relaxed by three years in the case of Ex-servicemen candidates. SCALE OF PAY: ₹51550-1230-58930-1380-63070.

PROBATION: A candidate selected will be initially on probation for TWO years or an extended period, if necessary and he/she must undergo such training as may be specified by the High Court

COMPETITIVE EXAMINATION:

  1. the Competitive Examination for recruitment of District Judges shall consist of 3 stages namely

(a) Preliminary Examination

(b) Main Examination and

(c) Viva voice:-

(a) PRELIMINARY EXAMINATION: The Preliminary Examination shall be conducted by way of an Objective Type Question Paper with multiple choices of 1½ hours (Ninety minutes) duration consisting of 100 marks. The syllabi for the said examination shall be the following, namely:-

3 Part-A – Civil Law.

Part-B – Criminal Law.

Part-C – General Knowledge (Test of reasoning and mental aptitude)

(b) MAIN EXAMINATION: The Competitive Written Examination for recruitment of District Judges shall consist of:

(i) Written examination of two papers each of three hours duration with 150 maximum marks for each piece – one in Civil Law and another in Criminal Law.

(ii) all candidates must answer at least one of the papers in the English language and in so far as the other paper is concerned, it shall be optional for the candidates to answer the same either in English or in Kannada in which event the said paper shall be answered entirely in the language in which option is exercised.

(c) VIVA-VOCE:

(i) The viva-voce shall carry a maximum of 50 marks.

(ii) The candidate’s General knowledge, grasp of principles of law, and suitability for appointment as District Judge shall be tested.

(1) Minimum marks for pass in the Preliminary Examination shall be 50 for candidates belonging to Scheduled Castes and Scheduled Tribes and 60 for others.

(2) The minimum marks for pass in each paper of the written examination carrying 150 marks, shall be 50 marks in each paper for candidates belonging to Scheduled Caste/Scheduled Tribe and 60 marks for others. However, the total marks to be secured for a pass in the written examination shall be 120 marks out of 300 for Scheduled Caste/Scheduled Tribe and 150 marks out of 300 for others. To be considered under General Category, a candidate belonging to the Scheduled Caste/Scheduled Tribe has to secure the minimum marks prescribed for the General category in the Preliminary Examination, Main Written Examination, and Viva-voce.

(3) From among the candidates who are eligible for Viva-voce as per clause

(2), as far as may be, such number of candidates as is equal to three times the number of vacancies notified, having regard to the number of vacancies in each reserved category, selected in the order of merit, shall be called for Viva voce.

(4) Candidate belonging to a Scheduled Caste or a Scheduled Tribe who obtains a minimum of forty percent and a candidate not belonging to a Scheduled Caste or Scheduled Tribe, who obtains a minimum mark of fifty percent in the viva-voce shall be eligible to be considered for selection to the posts. 4

(5) Selection of candidates shall be made in the order of merit based on an aggregate of the marks obtained in the Written Examination and Viva-voce test, subject to the Government Orders relating to reservation of posts for Scheduled Castes, Scheduled Tribes, and other backward classes. Provided that no candidate has secured less than the minimum marks specified above:

(i) Any paper of the Written Examination shall be eligible for Viva-Voce.

(ii) Any paper of the Written Examination or viva-voce shall be eligible for appointment as District Judge.

DISQUALIFICATION FOR APPOINTMENT:

No person shall be eligible for an appointment to the service –

(a) Unless he/she is a citizen of India;

(b) If he/she is compulsorily retired, removed, or dismissed from judicial service or service in Government or Statutory or Local Authority or if a candidate after being selected as a Judicial Officer has been discharged from service during the probationary period.

(c) if he/she has been convicted of an offense involving moral turpitude or who is or has been permanently debarred or disqualified by the High Court or the Union Public Service Commission or any State Public Service Commission from appearing for examinations or selections conducted by it or has been removed from its roll by any Bar Council;

(d) If any penalty or punishment has been imposed by the Bar Council or any Disciplinary Authority which in the opinion of Selecting Authority, makes the applicant unsuitable for a judicial post;

(e) If he/she directly or indirectly influence the Recruiting Authority by any means for his/her candidature;

किन परिस्थितियों मे ‘ किसी व्यक्ति से परिशति कायम रखने तथा सदाचार के लिए प्रतिभूति की मांग की जा सकती है ? प्रक्रिया बताइये ?

प्रश्न :-  किन परिस्थितियों मे ‘ किसी व्यक्ति से परिशति कायम रखने तथा सदाचार के लिए प्रतिभूति की मांग की जा सकती है ? प्रक्रिया बताइये ?

उत्तर :- दंड. प्रकिया संहिता अध्याय 8 , की धारा 106- 110 तक ऐसी परिस्थितियों का वर्णन किया गया है जिसमें किसी व्यक्ति से परिशत्ति कायम रखने तथा सदाचार के लिए प्रतिभूति की मांग की जा सकती है ,

 धारा 106  दोषसिद्धि पर परिशान्ति कायम रखने के लिए प्रतिभूति

(1)जब सेशन न्यायालय या प्रथम वर्ग मजिस्ट्रेट का न्यायालय किसी व्यक्ति को उपधारा ( 2 ) में विनिर्दिष्ट अपराध ( विधि विरुद्ध जमाव, बलावा करना, आपराधिक अभियात्र ) के लिए दोषसिद्ध ठहराता है , तो वह उसी समय दण्डादेश देते समय उस व्यक्ति से परिशत्ति कायम रखने के लिए , प्रतिभू सहित , रहित , बन्धपत्र निष्पादित करने का आदेश दे सकता है । यदि ऐसा किया जाना न्यायालय आवश्यक समझता है । ऐसा बंधपत्र तीन वर्ष की अनधिक की अवधि के लिये लिया जा सकता है,

उपधारा (3) के अनुसार यदि दोषसिद्धि अपील पर या अन्यथा अपास्त कर दी जाती है तो वह बंधपत्र शून्य हो जाएगा

(4) इस धारा के अधीने आदेश अपील न्यायालय या पुनरीक्षण न्यायालय द्वारा भी किया जा सकता है ।

मधु बनाम एस . .डी.एम मुंगेर A.I.R. 1971 SC के वाद में अवधारित किया गया कि धारा 106 के अधीन परिशांति कायम रखने के लिए बन्धपत्र निष्पादन की बाध्यता दण्डादेश देते समय ही किया जा सकता है ।

धारा 107 अन्य दशाओं में परिशान्ति कायम रखने के लिए प्रतिभूति

 ( 1 ) जब किसी कार्यपालक मजि ० को सूचना मिलती है कि सम्भाव्य है कि कोई व्यक्ति परिशन्ति भंग करेगा का लोक प्रशन्ति विक्षुब्ध करेगा था ऐसा सदोष कार्य करा तो वह ऐसे व्यक्ति से – 1 वर्ष से अनधिक की अवधि 13 लिए परिशन्ति कायम रखने के लिए प्रतिति की माँग कर सकता है ।

( २ ) इस धारा के अधीन कार्यपालक मजि ० के समक्ष कार्यवाही की जाएंगी जिसी स्थानीय अधिकारित में ऐसा स्थान / व्यक्ति हो – जहां परिशान्त भंग या विक्षुब्ध होने की सम्भावना है ।

NOTE धारा 109 के अन्तर्गत द्वारा लिए धारा दण्डनीय संज्ञेय अपराध कर रहा है तो सदाचार बनाए प्रतिभू सहित , रहित

सदाचार के लिए प्रतिभूति की मांग 

{108 – 110}

धारा 108 के अंतर्गत राजद्रोहात्मक बातों को फैलाने वाले व्यक्ति से कार्यपालक मजिस्ट्रेट द्वारा सदाचार बनाए रखने के लिए 1 वर्ष से अनधिक की अवधि के प्रतिभूति की मांग की जा सकती है ,

नोट :- 108 के अधीन ऐसे व्यक्ति से प्रतिभूति की मांग की जाएगी जो की धारा 124A 153A , 153B , 295A , 292 , के अधीन दण्डनिये अपराध करता है ,

संदिग्ध व्यक्तियों से सदाचार के लिए प्रतिभूति जब किसी कार्यपालक मजि. को यह सूचना मिलती है कि उसके स्थानीय क्षेत्राधिकार के अन्तर्गत कोई व्यकि संज्ञाये अपराध करने के आशय से अपनी उपस्थित छिपाने का प्रयास कर रहा है तो माजि ० ऐसे व्यक्ति को एक वर्ष से अनधिक अवधि के लिये सदाचार बनाये रखने को प्रतिभू सहित /रहित बन्धपत्र निष्पादित करने का आदेश दे सकता है

धारा 110 , आभ्यासिक अपराधियो से सदाचार के लिए प्रतिभूति 

110 कार्यपालक मजि ० सूचना मिलने पर अपनी स्थानीय अधिकारिता के अन्दर आभ्यासिक अपराधियों से सदाचार के लिए 3 वर्ष से अनधिक अवधि के लिए प्रतिभूओं सहित बन्धपत्र निष्पादित करने का आदेश दे सकता है ।

वह ऐसा आभ्यासिक अपराधी है जो – 

(1) अभ्यासत : लुटेरा , ग्रहभेदक , चोर , कूटरचयिता है

(2) चुराई हुई सम्पत्ति का अभ्यातः प्रायक है

(3)अभ्यासत : चोरो को पनाह ( संश्रय ) देता है

(4) व्यपहरण , अपहरण , उद्दापन , छल या शिष्ट से दण्डनीय देता है भा.द.स. अध्याय 12 में तथा 489A 489B 489C 489D से दण्डनिये अपराध दुष्प्रेण करती है .

(5) अभ्यास्त परिशंति भंग करने वाला है

( 6 ) निम्न अधि. के अंतर्गत कोई अपराध /उसका प्रयत्न / दुष्प्रेण अभ्यास्त करता है

 – अधिनियम व प्रशाधन सामग्री अधि. , विदेशी मुद्रा वि . अधि ० , कर्मचारी भवि . निधि अधि खाद अपमिश्रण निवारण अधि . , आवश्यक वस्तु अधि., अस्पृश्यता अपराध अधि., सीमा – शुल्क अधि., विदेशियो विषयक अधि., जमाखोरी , मुनाफाकोरी खद्य औषधि अपमिश्रण | भ्रष्टाचार निवारण विधि के अधीन दण्डनीय अपराध है 

(7) दुस्साहयिक , भयंकर है जिसकी प्रतिभूति लिए बिना रहना समाज के लिए हानिकारक है ।

Justice U.U. Lalit has practiced as a Senior Advocate in the Supreme Court,
Justice Lalit was directly elected as a judge of the Supreme Court by the senior advocate in the Supreme Court, From the Supreme Court Collegium in July 2014, he was appointed by Chief Justice J.S. Lodha and Pranab Mukherjee.

Chief Justice of India U.U. Lalit will retire on 8 November 2022 after assuming the office of the Chief Justice of India for 74 days as the 49th CJI.

Justice U.U. Lalit was born in U.R. He was born in Lalit’s family. U.R. Lalit was also associated with the legal profession. Lalit is a former Additional Judge of the Bombay High Court Nagpur Bench and a senior advocate practicing in the Supreme Court of India.

Justice U.U. Lalit joined the legal profession in June 1983 and started practicing in the Supreme Court of India in 1986. From 1986 to 1992, Lalit worked with former Attorney General of India, Soli Sorabjee, cases.

Justice U.U. Lalit as a Criminal Advocate Justice U U Lalit, who became famous, appeared in the country’s high-profile criminal cases, and his clients included many politicians and film stars.

Justice U.U. Lalit was appointed Special Public Prosecutor in 2011 for the Central Bureau of Investigation (CBI) in spectrum cases by a Supreme Court bench of Justices Singhvi and A.K Ganguly and observed that “In the interest of fair prosecution of the case, the appointment of UU Lalit very appropriate”.

Justice U. U. Lalit, while working as an advocate, has been observed to have patience in explaining legal questions and a calm demeanor in presenting the matter before the bench while advocating in criminal law cases.

On 10 January 2019, Justice Lalit recused himself from the five-judge bench set up by the Supreme Court to hear the disputed Ayodhya case.

Justice Lalit will succeed Justice CV Ramana to become the Chief Justice of the 49th Supreme Court of India on August 27, 2022.

Wherever final marks in the qualifying degree have been awarded as letter grade (CGPA/GPI/SGPA etc), equivalent percentage of marks shall be calculated as per conversion formula issued by respective institute/university for establishing eligibility criteria. Such candidates would be required to submit the conversion certificate issued by the concerned institute/university at the time of Personal Interview, if shortlisted.

5. However, in case the institute does not follow any conversion formula for converting CGPA to Percentage, the candidate will have to submit a certificate to this effect duly issued by concerned institute/university at the time of Personal Interview, if shortlisted. In such cases, IOCL shall be at liberty to arrive at equivalent percentage of marks following its own conversion formula.

1. Leave granted.

2. This appeal is at the instance of the original complainant
(husband of the deceased) and is directed against the order passed
by the High Court of Jammu and Kashmir at Srinagar dated
26.11.2020 in the CM (M) No. 99 of 2020 by which the High Court
rejected the revision application filed by the appellant herein thereby affirming the order passed by the Additional Sessions
Judge, Sopore (trial court) discharging the original accused persons
(respondents Nos. 1 to 7 herein) from the offence of murder
punishable under Section 302 of the Indian Penal Code (for short,
‘IPC’). Upon affirmation the trial court proceeded to frame charge
against the accused persons for the offence of culpable homicide
punishable under Section 304 of the IPC.

FACTUAL MATRIX

3. It appears from the First Information Report (FIR) bearing
No. 26/20 dated 22.03.2020 lodged by the appellant with the police
station situated at Dangiwacha that on the fateful day, the accused
persons formed an unlawful assembly and laid an assault on the
appellant and his family members after trespassing into the
residential property of the appellant herein. It is the case of the
prosecution that all the accused persons trespassed into the
residential property of the appellant and started damaging the tin
fence. When the appellant herein tried to restrain the accused
persons from causing any further damage, they all started
assaulting the appellant by giving fisticuffs. One of the accused persons is said to have hit the appellant with a wooden log. The wife
of the appellant herein and his daughter­in­law viz. Rubeena
Ramzan came to the rescue of the appellant. The accused persons
are alleged to have caught hold of the deceased (wife of the
appellant herein) and the daughter­in­law and both were beaten up
causing injuries. It is further alleged that the two female members
of the family were dragged by the accused persons as a result the
clothes of the deceased got torned thereby outraging her modesty.

4. In connection with the aforesaid incident, the appellant went
to the police station at Dangiwacha and lodged the FIR. The FIR
was initially registered for the offences punishable under Sections
147, 354, 323 and 451 respectively of the IPC. The deceased (wife
of the appellant) had to be shifted to a hospital as she suffered
injuries on her body. No sooner the deceased was brought to the
hospital than she was declared dead by the doctor on duty. In such
circumstances, Section 302 of the IPC came to be added in the FIR.
The post mortem of the body of the deceased was performed. The
statements of the various eye witnesses to the incident were
recorded. Various panchnamas were drawn. At the end of the investigation, the police filed charge sheet against the accused
persons for the offence of murder along with other offences as
enumerated above.

5. The cause of death of the deceased as assigned in the post
mortem is “cardio respiratory failure”. No poison was detected in
the viscera.

6. It appears that the trial court heard the prosecution as well as
the defence on the question of charge. Ultimately, the trial court
thought fit to discharge the accused persons of the offence of
murder punishable under Section 302 of the IPC and proceeded to
frame charge against the accused persons for the offence of
culpable homicide punishable under Section 304 of the IPC.

7. The appellant herein, being aggrieved by such decision of the
trial court to discharge the accused persons of the offence of
murder, challenged the legality and validity of the order by filing a
revision application before the High Court. The High Court thought
fit to affirm the order passed by the trial court discharging the
accused persons of the offence of murder.

8. In such circumstances referred to above, the appellant has come up with the present appeal before this Court.

In case of non – availability of candidates belonging to reserved categories , the posts will be filled by General candidates .

Eligibility criteria :

  • Educational qualifications : Full time degree in Law ( 3 year course or 5 – year course ) ( Final year law students awaiting for results are also eligible to apply , but they will be engaged only after producing their pass certificate . )
  • Age Limit : 21 years 30 years Upper age is relaxable by 5 years for SC / ST applicants and 3 years for OBC applicants .
  • The crucial date for determining eligibility criteria viz . , educational qualification , age etc. shall be as on 1.7.2022 .
  • Only eligible applicants who fulfill the criteria of essential qualification , age , etc. prescribed for respective position shall apply .
  • Qualifications mentioned above should be from any of the recognized Indian Universities duly approved by the UGC or any of the recognized Indian Institutes or recognized International Universities .

Role and responsibilities for the above position :

Assisting Chief Law Officer / Dy . CLO / Sr. Law Officer / Law Officer in all legal matters such as –

  • Drafting and issuance of Show Cause notices .
  • Collection of information for drafting of petition and verification of petitions .
  • Maintenance of the records and daily order sheet , recording of proceedings .
    Assisting in drafting various types of orders .
  • Assistance in recovery of arrears .
    Assisting in execution of the orders for receipt of possession o 1 premises .
    Any other work entrusted to them from time to time .
  • Period of contractual engagement : The contract will be for a period of one year which is extendable by one more year at a time at the discretion of the Port .

Method of selection :

Depending upon the response , the administration reserves the right to conduct written test or interview or both .

This is only a contractual assignment and they will not be eligible for regularization or permanency etc.

The other terms and conditions of the contract are given at Annexure I.

  1. Self- attested copies of documents / certificates relating to Age / Qualification etc. will have to be submitted along with the application and candidates shall produce the original certificates ( s ) for verification at the time of interview .
  2. Appointment of selected candidates is subject to their being found medically fit as per the requirements of the Mumbai Port Authority . Such appointment will also be subject to the service and contract rules of the Mumbai Port Authority .
  3. Decisions of the Mumbai Port Authority in all matters regarding eligibility , shortlisting and selection shall be final and binding on all candidates . No representation or correspondence will be entertained by the Mumbai Port Authority in this regard .
  4. Any legal proceedings in respect of any matter of claim or dispute arising out of this advertisement and / or an application in response thereto can be instituted only in Mumbai .
  5. No TA / DA will be paid for appearing in written examination / interview , if called .
  6. Any update , corrigendum etc. of this advertisement will be displayed in the Port’s website only . Hence , candidates are requested to keep in regular watch on Port’s web  www.mumbaiport.gov.in  under Media / Vacancy menu.
  7. Changes if any in the recruitment process will be displayed in this Port’s website and no separate communication will be made to the individual applicant .
  8. Canvassing in any form will disqualify the candidate and no correspondence shall be entertained in this regard .
  9. The Management reserves the rights to cancel or make any changes in the number of vacancies , alteration / additions / deletions of any clause in the Terms and Conditions for any of the position ( s ) in the recruitment process , if need arises , without further notice and without assigning any reasons thereof .The Mumbai Port Authority also reserves the right to cancel the above recruitment exercise at any stage of the process without assigning any reason thereof .
